Abstract

The research for new drugs and their developement grew increasingly expensive within the last decade. Patent protection often assures the amortization of such investments and therefore needs to be extended to as many markets as possible. The WTO tried so by implementing the TRIPS agreement. While enforcing patent owner rights TRIPS established more restrictions to the production and trade of generic drugs. These new restrictions made it significantly harder for poor countries to gain access to essential drugs at reasonable prices. In this essay we will try to shed some more light on the backgrounds of the TRIPS agreements as well as on its consequences. We will show how TRIPS complicates the developing countries' struggle against epidemics such as HIV/AIDS and identify the main problems which have to be solved in order to correct this actual situation.
